FINAL PROVISIONS:


A. Effective January 1, 2012, the Department shall enter into a cooperative agreement with the Mississippi River Authority (RRA) to establish a grazing program to be funded through grants. The Department shall allocate $4 million for the RRA grazing program in fiscal year 2012 to the two regions that receive the highest percentage of the RRA-granted grazing allotments. In fiscal year 2012, if the three regions together received the highest percentage of the RRA-granted grazing allotments, the Department shall allocate $4 million for the RRA grazing program in fiscal year 2013 in addition to this allotment, with $5 million remaining as the first installment of this amount if the other three regions receiving the RRA-granted grazing allotments do not meet the high percentage requirement. If none of the three regions receives the highest percentage of the RRA-granted grazing allotments, the Department shall allocate the $1 million for the RRA grazing program in fiscal year 2013. If all three regions receive the highest percentage of the RRA-granted grazing allotments, all $4 million remains in the RRA grazing allotment program. The BLM will determine the funding for the three regions as part of the grant application. In the event of the RRA-granted allotment to each region to exceed the established grazing requirement for each state, the RRA, in consultation with its local, state, regional, and territorial governments and the state's Environmental Protection Agency, shall establish grazing areas and provide other appropriate measures to ensure adequate resource conservation and protection in accordance with the National Environmental Policy Act. In establishing grazing allotments under this section, the Secretary shall ensure compliance with federal, state, and local laws prohibiting grazing on public lands. These grazing areas shall be in accordance with current and historic standards that govern the management of public land. The BLM will consider, as part of this arrangement, any recommendation made by the Secretary by the Commission on Rural Development to address and promote sustainable management practices in managing the BLM lands.
